First steps to take
- Use the calculator now by entering your price and down payment. Before you make an offer, it shows your total and who pays each cost.
- The transfer tax is usually paid by the seller. If you accept the deed before the tax is paid, you owe the bill; check that it has been settled first.
- Request two amounts: the title policy cost and separate charges for record searches, escrow and handling the closing.
- For a sale made for money, the county clerk collects $20 before recording it.
West Virginia's transfer tax
West Virginia taxes a home whenever ownership changes. The state calls this charge its excise tax for the privilege of transferring real property. State law makes the seller responsible for a rate of 0.22% of the sale price. The seller's 0.22% tax on a $177,000 home totals $389. Separate charges include the county's 0.11% tax and the $20 fee.
This tax becomes the buyer's responsibility when they accept the deed before it has been paid. The buyer also pays if a trustee or county clerk sells a home to collect unpaid taxes.
For every $500 of the price, counties charge another 55 cents, or 0.11%. A county commission can set the rate at up to $1.65 per $500. Before the meeting where the increase will be discussed, it must publish notice 30 to 60 days ahead. A separate $20 fee also applies to sales for money. Before recording, the county clerk collects the fee and sends the proceeds to the Affordable Housing Fund.
Do seller costs come out higher here than elsewhere?
A $400,000 sale has a 0.22% transfer tax of $880. The county tax and the separate $20 fee are added on top, so $880 does not cover everything the seller owes before commission or mortgage payoff. The median among states is $440, which means a West Virginia seller pays $440 more. Among the 36 states, including DC, that charge a transfer tax, West Virginia ranks 24th from the highest.
Buyer totals fall near the middle of the group. At a $400,000 price with 20% down, buyers here reach $7,844 in closing costs. Across the 50 states and DC, the median is $7,850, just $6 higher.
Coverage for the title and recording charges
Commercial and noncommercial property have separate rates in West Virginia, where each insurer submits its own rates Ask for the policy price and the charges added on top of it for record searches, escrow and closing services.
Public county records include both the sale and mortgage after recording. The Fayette County clerk charges at least $27 to record a deed and $27 to record a mortgage. As an estimate, we apply Fayette County's $27 minimum to both recording fees, though your county may charge a different amount.

Who handles West Virginia closings?
Real estate closings had to be handled by licensed attorneys or their supervised staff, according to a West Virginia State Bar committee in 2003. A Justice Department brief shows that the state Supreme Court had not yet issued a decision on this opinion, so the rule remained unsettled.
Know your numbers ahead of any offer: put your price and down payment into the calculator, and it shows what you'll owe at closing alongside what the seller owes, including the transfer tax, which shifts to you if you take a deed while that tax is unpaid.
