How North Dakota differs

  • There's no state transfer tax on a deed in North Dakota. landcan.org
  • A $20 recording fee covers documents with 1-6 pages, while documents with 7-25 pages carry a $65 fee. If the recorder has to add a page, making the document 7 pages instead of 6, the $65 fee applies. starkcountynd.gov
  • Either the full consideration paid or an exemption that the grantee believes applies must appear on a deed or affidavit of affixation. starkcountynd.gov
  • No deed can be recorded unless it lists each grantee's post-office address and, for property inside city limits, a street address. starkcountynd.gov
  • If a deed or contract for deed carries a metes and bounds description, it must name whoever drafted that description and give their address; otherwise it can't be recorded. starkcountynd.gov
  • After the assessment year, property tax comes due January 1, and no penalty applies if you pay by March 1. Full payment by February 15 earns you a 5% discount; closing proration takes that discount into account. tax.nd.gov
  • Recording fees: $20 for the deed and $20 for the mortgage, under the Stark County schedule (NDCC 11-18-05), where the base fee covers 1-6 pages. starkcountynd.gov

What closing costs look like on less and more expensive homes

Across North Dakota home types in September 2026, the least expensive third of homes had typical values of $167,473 and the most expensive third $458,548. Across that spread and with 20% down, buyer closing costs go from $4,049 to $9,006.

Buyers of a $400,000 home in North Dakota pay $7,830 in closing costs with 20% down. Across all 50 states and DC the national median is $7,850; North Dakota sits $20 below that.

Seller costs in North Dakota

Sellers owe nothing on closing-cost lines here, aside from commission and any mortgage payoff. For a $400,000 sale price, sellers in the median state pay $440, which puts sellers in North Dakota $440 ahead.

For agents, commission is handled in a different way. Nationally, commissions for buyer's agents average 2.42% of the price. Once you enter a rate, the calculator adds this fee.

Fees and rules for recording a deed

Stark County's recording fees apply to each document: 1 to 6 pages cost $20, and 7 to 25 pages cost $65. If the recorder adds an extra page and a 6-page deed becomes 7 pages, then $65 applies rather than $20.

A deed also has to clear a few checks before the county will record it:

  • It must show either the full purchase price paid or the exemption the buyer claims; an affidavit of affixation must follow the same rule.
  • Every buyer's post-office address must be listed; a street address is also required if the property lies inside city limits.
  • If a description follows metes and bounds, the deed must identify its drafter and include that person's address.

Instead of a lot number, metes and bounds identifies land by measured boundaries and directional turns. A contract for deed has to meet this same requirement.

Closing day and property tax

In North Dakota, property tax comes due January 1 following the assessment year. Pay through March 1 without a penalty; pay the entire bill by February 15 and you get a 5% discount.

Proration is why the discount matters at closing: it splits the year's tax bill between buyer and seller based on how long each one owns the home. The median annual tax bill in North Dakota for an owner-occupied home is $2,468, about 0.99% of the median value of homes.
