Who pays closing costs in Oklahoma
At 0.15% of the sale price, Oklahoma places a stamp tax on the deed for home sales. Who pays is not settled by the state's guide Your agreement determines how the tax is split, since anyone who signs, issues or sells the deed, or gains from it, may be liable. Our calculator lists this tax under the seller.
Oklahoma's stamp tax is its transfer tax and totals $600 for a $400,000 home. That makes Oklahoma 27th of the 36 places charging this tax. A seller in the median state pays $160 less before commission.
Recording requires the deed to carry stamps bought from county clerks. The deed must also include the buyer's name and address. A willful failure to buy and put on the proper stamps can lead to a fine of up to $1,000. It can also mean jail for up to a year, or both.
Some sales pay nothing. This tax applies only when the price exceeds $100; the taxable amount leaves out any mortgage still attached to the property. This tax does not apply when a home transfers between spouses, parents, children or other close relatives without any payment. A foreclosure deed made out to the mortgage holder is also exempt; for other foreclosure sales, the buyer pays.
